It is extrememly important that, if you are a planner, to review your client’s Prenuptial Agreement and be sure that the provisions of your clients’ documents reflect the provisions of the Prenuptial Agreement. If you are hiring an attorney, then be sure that the attorney drafting the Prenuptial Agreement not only understands the “divorce” provisions but also the estate planning and “death” provisions. If not, hire a planner to work with the family law attorney.
