“Sam and Sally have been married for 10 years and have a minor daughter, Suzie. Sam and Sally do not have a lot of assets, but Sam has his work income, a life insurance policy and a retirement plan. Together, he and Sally own their home with a mortgage owed to the bank. Sam and Sally, like many young couples, do not understand a Last Will and Testament or if they even need one because they have designated their spouse as the primary beneficiary of their 401(k) plans, life insurance policies with Suzie as the contingent beneficiary. Their home is titled in joint names. If anything happens to both of them, all of their assets would be distributed to Suzie. So, isn’t that enough? Why would they need a Last Will and Testament?”
